Hey kids, here's a little bit of mental aerobics for you:....A while back, farting about the net I ran accross this guy:
http://www.seriousgraphics.biz/pages/products/productsfineart/pictures/1987-bambioid2.html Now,my 15 yr. old daughter knows more about computor stuff than I ever will,so I don't really know how to do the link thing(sorry  ) Anyway, the question is this;is the guy at this site a low life crook,or a talented, but stupid git that knows little or nothing about copyright law?check it out if you like, and get back to me(Jer) |

WHAT
I should say, what does is he think he's trying to sell? He seems to have the idea that if he draws it, the art is copyright to him regardless of the origin of the subject matter.
I don't know about the 'talented' part, but yes, he's obviously a git. |

Rips of some furry artist's creations. I think I've seen the style before, but I can't place the original artist's name... maybe Jerry knows? |

A site called "Serious Graphics" presenting badly made tracings of other people's art, now that's quite something.
A quick look around the site reveals plenty of logos and references to numerous well-known firms and brands - it's a safe bet this Johnson fellow had fuckall to do with them. Most likely he's a clueless git who thinks he can get jobs by pretending to be big and important:
Serious Graphics is the Graphic design division of Johnson Industries.
... sounds big, doesn't it? But the Key Personnel link names but one person, mr. Johnson himself.
I say he's a pompous wanker without a clue. |

Apparently he's on to us, I can't get into the site or access the image folders directly. Not that I was all that keen on traced pseudo shaded bambi sluts from hell. |

Oh "good" it's back up. Wow, this is really bad stuff. And what's funny is he has the nerve to call it "fine art". There's nothing fine, good, or marginally competant about it.
Straight dope, playa. |

Wotta hack. Everyone knows that Noah Ward is the only one capable of doing any justice to Jer's art, and he's had the decency to have it licensed by Jer too. ;) |

I just noticed that Jerry Collins hasn't posted anything to his VCL gallery is almost ten years, I didn't even know VCL had been around that long
Anyway, consider this as a call for him to post something (if anything, jsut for laughs) |

It sucks, seriously I wouldn't freaking care. Besides it's not like jerry is the only one to draw bambi like morphs, I've got my own sketches of that type of character somewhere. |

Uhhh,D.A.,it's like this, true there are artists such as Joseph Ny( and Who ever the heck it was that came up with Fawn Deer at Disney)that have morphic deer folk, hell, you could include Jay Ward's bullwinkle as well...but the fact of the matter is Mr.Johnson used the (C) name of my characters and my d esign, now my dear D.A.,how would you feel if somebody stole YOUR characters?....plenty PISSED OFFED I'd bet!!!!!!simply put,not since Taral Wayne's infamous "barrowing" of my characters(later half-assedly re editing the art) in his "Warbirds" booklet has there been such an obvious act of plagerism!so,there it is..I don't have the money or wherewith all to defend my work with, just a few government documents(my copyright papers),luck, and Jah's grace to keep theive at bay.(Jer) |

Then Jer, your design is as generic as hell. Nobody touches my characters, probably because they're unique and hard to rip off that and if they did snaffle one they'd probably steal a random one that means fuck all to me.
Also you can't copyright names, god you've been an artist way longer than me and you don't even know this simple fact? Also the (c) has no legal force as it's not officially recognised. Were the circle complete then it would be recognised. :P |

Copyright takes effect from the moment someone creates something that expresses an idea, like a drawing or written work. You don't have to include the (c) sign and you don't even have to register it with a copyright office-- a useless measure because copyright offices don't actually enforce a lot copyright, only certain types. For example, in the USA commercial copyright violation involving more than 10 copies and value over $2500 is a felony (http://www.templetons.com/brad/copymyths.html -- see No. 8 ), which is why people can get arrested for setting up a stall selling burnt DVDs. Thus, nearly all copyright legislation lies under civil law. Copyright offices just give you some extra proof that you created the image. But it's cheaper to send a photocopy of your image with the date stamped on it and send it to yourself via registered post, which is a method a lot of screenwriters use. That way the date will be on the envelope and your image. All you have to do is submit the sealed envelope as evidence, and lo and behold the gloves fit!
Jerry is entitled to pursue the LAWSUIET if he wishes -- the law is totally on his side and I'm sure he can easily prove the website owner traced his pictures.
The question is, is it actually worth it?
In my opinion, it's not.
It sucks, but that's life. |

Well, I don't see the guy making any money off of Jerry's designs (I don't see the guy making any money off of anything actually), and I don't see Jerry losing money from those 'bamboids' either. Even if you win, it's not like you could get anything from him, and if you could what would they be worth?
Even odds, no one wins! |

Yes, but when push comes to shove, copyright law is about protecting the economic interests of the copyright holder. So if a person who nicked someone else's intellectual property did not strip the copyright holder of an income - and I agree with Skunkfuckers Inc. that it's very unlikely that this Johnson guy is making money at all - then there is no case. Otherwise the courts would be swamped with lawsuits from KAK and Zeriara... |

Actually, that's something I didn't consider. I automatically assumed Jerry was making money off these specific sketches. Is he or are they public domain? If they're public domain, then yeap the case wouldn't even go to trial. |

I don't even think Jerry is an active artist anymore. The most I've seen is leftover bits from old furry porn art collections. Not much else to say there. |

With the re-establishment of the forum, it was found that all of what happened after a certain period of time was lost. Therefore it's as if some posts, threads, and locks never happened. It's also why I found my avatar as Big Boss instead of Laibach (which is what I had at the time of CYD's hiccup).
Oh and ... art is life. |
